CHARLOTTE, S.C. (FOX Carolina) – The Atlantic Coast Conference (ACC) filed a lawsuit Wednesday night in response to Clemson’s recent lawsuit against the conference.
Wednesday’s lawsuit came just a day after Clemson sued the ACC, alleging that the extension of the ACC’s media rights hinders the university’s ability to negotiate alternative revenue-sharing proposals for home games broadcasts and “explore its options regarding conference membership.”
The ACC has said it owns the broadcast rights to the home game Clemson plays through 2036, even if the institution ends its membership with the conference, and that there is a $140 million penalty for any institution wanting to leave the conference.
The ACC’s lawsuit argues that Clemson supported the withdrawal payment and the broadcast rights agreement when they were approved in past votes.
According to the lawsuit, the ACC is trying to get a declaration that Clemson must pay the withdrawal fee and abide by the broadcast rights agreement through 2036, regardless of whether the school is still a conference member. The ACC is also reportedly seeking damages for Clemson’s breach of the Grant of Rights and the covenant of good faith and fair dealing.
Clemson declined to comment on the lawsuit and referred to the statement they shared alongside the lawsuit the school filed Tuesday.
