Tigercat International Inc. asked a federal court to revive its trademark application for offroad industrial equipment and find it doesn’t infringe
The Trademark Trial and Appeal Board made several errors when it sided with Caterpillar in rejecting Tigercat’s registration bid earlier this year, Tigercat said in its Tuesday complaint in the US District Court for the District of Delaware. Mistakes included finding the marks similar, and discounting a 1999 Tigercat registration and decades of coexistence with Caterpillar, it said.
