Patent Dispute Between Nike, New Balance Put on Pause, Judge Rules


A federal judge in Massachusetts agreed to pause a patent dispute brought by Nike against New Balance Athletics over its “Flyknit” footwear technology, pending decisions that challenged six out of the nine patents also at issue in the current case.

On Friday, U.S. District Judge Julia E. Kobick for the District of Massachusetts granted New Balance’s motion to stay the proceedings in a patent dispute with Nike until Aug. 9, when the Patent Trial and Appeal Board (PTAB) of the U.S. Patent and Trademark Office (USPTO) is expected to make decisions in inter partes reviews (IPR) of some of the patents regarding the design and manufacture of the top part of a shoe. New Balance requested the stay, pending the decisions to the challenged patents brought by New Balance and non-party sellers Skechers and Lululemon.
