Aldi is being sued yet again for trademark infringement. Mondelez International, one of the world’s largest multinational food companies, says that the German-based supermarket chain is trying to dupe customers by packaging it store brands in what are “blatantly copies” of its name signature snacks like Oreo, Chips Ahoy and Wheat Thins.
Mondelez is seeking monetary damages and a court order that would prevent Aldi from selling products that the snack maker claims infringe on its trademarks. It says that the packaging in question threatens “irreparably harm Mondelez and its valuable brands” by diluting “the distinctive quality of Mondelez’s unique product packaging.”
Inspiration or outright plagiarism?
The Mondelez’s lawsuit claims that the packaging of the Aldi knock-off products have many similar design elements such as the colors, fonts, graphics, and product names. The suit includes side-by-side images of the brands to make clear the similarities between the original and the copy.

The tactic of making an off-brand product appear deceptively similar to its name brand counterpart is nothing new. Nor is this the first time that Aldi has been sued for creating a generic product that is strikingly similar to a name brand.
Aldi recently lost lawsuits in Australia and the UK for infringing on the trademarks of a cider company, Thatchers, and a children’s snack brand, Every Bite Counts.
